Terms of use

The German version of these terms is the binding one. This English version is provided for convenience.
1. Who we are and what these terms cover
YesTrip is an AI travel planner by John Henry Herzel – YesTrip, c/o flexdienst – #20713, Kurt-Schumacher-Straße 74, 67663 Kaiserslautern, Germany ("we"). These terms apply to the use of the website yestrip.app, the web app at app.yestrip.app and the Android app "YesTrip" (together "YesTrip"). By using YesTrip or creating an account, you agree to these terms.
2. What YesTrip is – and what it is not
YesTrip helps you plan trips: with maps, plan items, suggestions from an AI and offers from our partners.
YesTrip is not a tour operator and not a travel agency. In particular:
- We do not book anything on your behalf and do not conclude contracts for you.
- We do not accept payments for travel services.
- We do not sell package holidays or linked travel arrangements. If the AI suggests combinations (e.g. flight and hotel), you book each service separately with the respective partner.
- We do not pass your data to airlines, hotels or partners.
3. Free, without guaranteed availability
YesTrip is free for you. We finance YesTrip through commissions from partner links (see section 7).
We strive for stable operation but do not guarantee any particular availability. Individual features (e.g. AI, partner search, third-party maps) may be temporarily unavailable, limited or changed. We may develop, change or discontinue features. Your content on your device is not affected. If we discontinue the account service, we will announce it with reasonable notice so you can keep your data on your devices.
4. Account
You need an account to use YesTrip (sign-in with your e-mail address and a code). Your trips are synced with your account; tickets, photos and the chat stay on your device only, and you are responsible for backing them up (e.g. with the app's export and backup features). AI features are limited by a monthly allowance of AI credits; everything without AI is not limited.
For the account the following applies:
- An account belongs to exactly one person. Do not share your access with others.
- Use an e-mail address that belongs to you and that you can access.
- You must be at least 16 years old.
- Keep your login codes secret. Contact us if you suspect misuse of your account.
5. Sharing trips
With an account you can share trips with others via a link or code. You decide whom you invite and whether they may only view or also edit the trip. Anyone with a valid invite link can join – so only pass it on to people who should see the trip. You are responsible for the content you make visible in a shared trip.
As the owner of a trip you see the members' e-mail addresses. Members see the display names of the other members. If you delete a shared trip or your account, the trip also disappears for all members.
6. AI features
YesTrip uses artificial intelligence (Claude by Anthropic) for chat, trip plans and suggestions. AI content is labelled as such in the app.
Please note:
- AI can make mistakes and give outdated or wrong information, e.g. on opening times, prices, distances, connections or safety.
- Always check entry rules, visas, vaccination and health requirements, travel warnings and opening times yourself with official sources (e.g. your foreign ministry) or the provider.
- AI suggestions are ideas, not advice and not a promise.
- Do not enter sensitive data in the chat (e.g. health data, ID numbers).
7. Partner offers and bookings
YesTrip shows offers from partners such as Travelpayouts/Aviasales, Booking.com, GetYourGuide or Viator. Partner links are marked "Partner link" or "Ad". If you book via such a link, the partner pays us a commission. Your price stays the same.
- The contract is concluded exclusively between you and the partner or service provider. Their terms and privacy rules apply.
- The partner is responsible for booking, payment, cancellation, changes and complaints.
- Prices, availability and information in YesTrip are non-binding guide values with the time they were retrieved. They can change at any time. Only what the partner shows you before booking is binding.
- Offers are ranked by the sort order you choose. By default: flights "Best" – mainly price, plus travel time and number of stops; flights from or to a nearby airport rank slightly lower (selectable: "Cheapest", "Fastest"). Accommodation from the partner search "Recommended" – mainly guest rating, plus price per night, distance and free cancellation (selectable: price, rating, stars, distance). The hotel list from OpenStreetMap by distance (selectable: stars, places with a photo first). Tours and activities by rating, weighted by the number of ratings; offers matching your search term come first. Train connections by departure time (selectable: duration, changes). The level of commission does not influence this order. Only where a flight is offered by several partners at the same price or without a known price, or where no prices are available yet for a flight search, do we name the partner with the higher commission first. Which further partners we show for your trip (e.g. eSIM, rental cars, transfers) follows a fixed order per category and region set by us.
8. Your content
Content you create in YesTrip (trips, notes, photos, travel profile etc.) remains yours. If you use an account, you only grant us the rights we need to store this content, sync it between your devices and show it to the people you share it with. This right ends when you delete the content or your account.
You may only add content for which you hold the necessary rights and which does not violate laws or the rights of others.
9. What is not allowed
- querying or reading out YesTrip or our interfaces (e.g. AI, partner search, account) automatically (scraping) or using them for anything other than your own trip planning
- circumventing security measures or limits, or overloading YesTrip
- using the AI for unlawful, offensive or harmful content
- creating accounts for others, impersonating someone else or using other people's e-mail addresses
- spreading unlawful content via shared trips
In case of violations we may remove content and suspend or close accounts. We take your legitimate interests into account and inform you where possible.
10. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and to the extent of any guarantee given.
For slight negligence we are only liable for breach of an essential contractual obligation (cardinal obligation). This is an obligation whose fulfilment makes the proper use of YesTrip possible in the first place and on whose fulfilment you may regularly rely. In this case liability is limited to the foreseeable damage typical for this type of contract.
Otherwise liability is excluded. In particular, we are not liable for offers, services and information from partners and third parties, or for content generated by the AI, unless we are at fault under the sentences above.
For loss of data stored only on your device we are only liable to the extent you have backed it up in a reasonable way.
11. Deleting your account and termination
You can delete your account in the settings at any time. This ends the user agreement for the account. What is deleted is described in the Privacy policy.
We may terminate the user agreement with 30 days' notice by e-mail. The right to terminate without notice for good cause (e.g. serious violations of section 9) remains unaffected.
12. Changes to these terms
We may change these terms if YesTrip, the law or our partners change. We inform account holders at least 30 days in advance by e-mail or in the app. The new terms only apply to you once you expressly agree to them (e.g. with a tap in the app). If you do not agree, the previous terms continue to apply to you; we may then terminate the agreement with the notice period from section 11. Changes that only fix typos, rephrase without changing the meaning or add new free features do not require consent.
13. Governing law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another country, the mandatory consumer protection rules of that country remain unaffected.
14. Consumer dispute resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
15. Severability
If any provision of these terms is invalid, the remaining provisions remain valid. The statutory provisions take the place of the invalid provision.
